Brian K. Stewart

Brian Stewart has practiced in the area of representation of professionals, predominantly in the construction arena, for over 20 years and enjoys working with smart, dedicated and interesting clients. He enjoys spending his spare time with his wife and three teenage children and has been involved in his children’s sporting and school activities. He and his wife have also enjoyed restoring their 1911 vintage farmhouse and tending to the mature citrus trees on their property. He also enjoys hiking and mountain biking on the weekends in the local mountains. He has assisted in his local community by serving on both the school board and as President of the Endowment Committee for his children’s school.

Brian is admitted to practice in the states of California and Illinois, the U.S. District Court, Central and Eastern Districts of California, and the U.S. Supreme Court. He is a frequent lecturer to public entities, architectural and engineering firms and other professional organizations. He is a member of the State Bar of California, the American Board of Trial Advocates (ABOTA), the American Bar Association, and the Association of Southern California Defense Counsel. He has also served as Trustee of the Los Angeles County Bar Association and President of the Pasadena Bar Association. He also edited the Pasadena Bar Bulletin for four years. Brian is an affiliate member of the American Institute of Architects (AIA) in the Los Angeles and San Fernando Valley Chapters. He served on the most recent AIA California Council (AIACC) ADAPT Handbook Update Committee and currently serves as the attorney representative on the Legislative Affairs Committee for AIACC. In addition, he previously served on the AIA Los Angeles Chapter (AIALA) Political Outreach Committee. Brian is a member of the American Council of Engineering Companies of California (ACEC California) formerly the Consulting Engineers and Land Surveyors of California (CELSOC) where he currently serves on both the Legislative and the Business Management and Insurance Committees.

His reported decisions include Greshko v. County of Los Angeles (1987) 194 Cal.App.3d 822 (good faith settlement), Markborough v. Superior Court (1991) 227 Cal.App.3d 705 (contractual limitation of liability), Hansen Mechanical, Inc. v. Superior Court (1995) 40 Cal.App.4th 722 (indemnity), and Paz v. State of California (2000) 22 Cal.4th 550 (private contractor’s liability for condition of public property which Brian successfully argued in the California Supreme Court). In addition, Brian acted as amicus counsel in McCarthy v. Teng Li, 4th Civ.No. G030544, on behalf of the National Society of Professional Engineers (NSPE), the Structural Engineers Association of California (SEAOC), and the California Society of Professional Engineers (CSPE) concerning application of the economic loss doctrine to design professionals in construction disputes.

Brian received his B.A. from Western Illinois University, honored as a member of the Pi Sigma Alpha Honor Society. He received his Juris Doctor from The John Marshall Law School, where he served as President of the Securties and Exchange Law Association and was a member of Delta Theta Phi.
